Administrative and Constitutional Law
We have extensive experience with the regulatory process, including and especially judicial review. From the preparation of comment letters to the drafting of appellate court briefs, our lawyers have participated in all stages of federal rulemaking. We are well-acquainted with the Administrative Procedure Act, including complex questions of standing, preliminary relief under Section 705, judicial review under Section 706, and all related judicial doctrines, such as Skidmore and Chevron.
Our lawyers have also helped to prepare legislation at the federal and municipal levels, and have substantial experience litigating and providing counsel about the constitutionality of statutes – particularly concerning the First Amendment and Dormant Commerce Clause.
We also have substantial experience with issues of state and local government law, with a special focus on the scope of municipal home rule and other limitations on local authority.
